2. Services Provided: Fat Rat Forge offers 3D printing services, including the production of physical objects from digital models provided by the Customer. We utilise various 3D printing technologies (e.g., FDM, SLA) and materials (e.g., PLA, ABS, Resin) as specified on our website or in communications.
3. Customer Responsibilities:
3.1. You must provide accurate and complete information when placing an order, including contact details, shipping address, and payment information. 3.2. You are responsible for ensuring the digital model is suitable for 3D printing and complies with our design guidelines, available on our website. 3.3. You warrant that you have all necessary rights, licenses, and permissions to use, reproduce, and distribute the digital model, and that it does not infringe on any third-party intellectual property rights.
3.4. You agree not to submit any digital models that are illegal, offensive, or prohibited by law, such as weapons or copyrighted material without permission.
4. Ordering Process:
4.1. Orders can be placed through our website and by email at fatratforge@gmail.com.
4.2. When placing an order, provide the digital model in accepted formats (e.g., STL, OBJ, 3MF, STEP), and specify material, colour, quantity, layer height, infill percentage, and other relevant options.
4.3. For large files, contact us directly. We reserve the right to refuse any order at our sole discretion, including those violating these Terms or technically infeasible.
5. Quotations and Pricing:
5.1. Quotations are provided based on information supplied by you and are valid for 30 days from the date of issue.
5.2. Prices may change due to fluctuations in material costs, labour, or other factors after the quotation period. We will notify you of any changes before processing.
5.3. All prices are exclusive of taxes, shipping, and handling fees, unless otherwise stated. Minimum order value is $20 AUD.
6. Payment Terms:
6.1. Payment is required in full before production begins, unless otherwise agreed in writing.
6.2. We accept payment via credit cards, PayPal, and bank transfer.
6.3. For orders over $500AUD, a deposit of 50% is required, with the balance due upon completion. Lead time starts after payment confirmation, processed the next working day if received after 4 PM.
7. Production and Lead Times:
7.1. Production lead times are estimates and may vary based on order complexity, current workload, and material availability. Standard lead time is 5-7 Business Days for small orders.
7.2. We will make reasonable efforts to meet estimated delivery dates but do not guarantee them, especially for delays due to equipment failure, supply chain issues, or force majeure events.
7.3. Print orientation and support structures are determined by us unless specified, optimising for quality and efficiency.
8. Shipping and Delivery:
8.1. We ship to the address provided, using standard courier services with tracking information provided where available.
8.2. It is your responsibility to ensure the shipping address is accurate and complete; no refunds for incorrect addresses. Changes possible pre-shipment.
8.3. Shipping costs are calculated based on weight, dimensions, and destination, and risk of loss transfers upon shipment.
9. Cancellations and Refunds:
9.1. Orders may be cancelled before production begins. A cancellation fee covering reasonable costs incurred up to that point (such as material procurement) may apply and will be clearly communicated.
9.2. Refunds for defective prints will be provided in accordance with consumer guarantees under the ACL. Customers must notify us within 10 working days of identifying the defect and provide photographic evidence. The defective item must be returned at no cost to the customer using a tracked service. Refunds, replacements, or repairs will be offered depending on the nature of the fault.
10. Quality Assurance:
10.1. We strive for high-quality prints but cannot guarantee perfection due to 3D printing limitations. Minor imperfections (e.g., layer lines, support marks) are normal and not defects.
10.2. Dimensional accuracy is typically within +/- 0.3mm or 0.3% of dimension, whichever is greater. Features smaller than 1.2mm may not be accurately reproduced.
10.3. If a print is defective due to our error, we will reprint or refund at our option, provided claims are made within 30 days of receipt with evidence.
10.4. We are not responsible for design flaws or suitability for purpose; customer must ensure regulatory compliance.
11. Intellectual Property:
11.1. By submitting a digital model, you grant us a non-exclusive, royalty-free license to use it solely for providing services.
11.2. We will not share, distribute, or use your digital model for other purposes without consent. You retain all ownership rights.
11.3. We reserve the right to refuse printing designs infringing third-party rights or violating laws.
12. Limitation of Liability:
12.1. Our total liability for any claim arising from these Terms or services shall not exceed the amount paid for the specific order.
12.2. We are not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or use.
12.3. In case of defects, our liability is limited to reprinting or refunding, at our discretion, with no compensation for missed deadlines due to delays.
13. Indemnification: You agree to indemnify, defend, and hold harmless Fat Rat Forge, its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys' fees) arising from your use of our services, violation of these Terms, or infringement of intellectual property rights.
14. Governing Law and Dispute Resolution:
14.1. These Terms are governed by the laws of New South Wales, Australia.
14.2. Any disputes shall be resolved through binding arbitration in Sydney, in accordance with the rules of Australian Centre for International Commercial Arbitration.
15. Miscellaneous:
15.1. These Terms constitute the entire agreement between you and Fat Rat Forge regarding the services, superseding prior agreements.
15.2. If any provision is found invalid or unenforceable, the remaining provisions remain in effect.
15.3. Our failure to enforce any right or provision does not constitute a waiver.

- Larger Orders ($200+): A 50% non-refundable deposit is required to start the project. The remaining balance is due upon completion and before delivery.

- Invoices will be sent via email and must be paid within 7 days of issuance.
4. Late Payments
- We reserve the right to pause or cancel services for accounts with outstanding payments older than 30 days.
5. Taxes and Fees
- All prices exclude applicable sales tax, which will be added based on your location.
- Shipping fees (if applicable) are calculated at checkout and paid upfront.

Consumer Guarantees under the Australian Consumer Law (ACL):
Our goods and services come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced (or services re-performed) if the goods or services fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in this policy limits or excludes your rights under the ACL or any other applicable laws.
Cancellations (Change of Mind):
- If you cancel before production starts, any deposit paid will be refunded minus a 10% processing fee to cover administrative costs (provided this fee represents a genuine pre-estimate of our loss).
- Refunds are available for cancellations after production begins, a fee will be applied depending on the estimated time of the cancellation. (The cost is calculated based on the time, material and labour time used.)
However, this does not affect your statutory rights if there is a fault or failure under the ACL.
Refunds and Remedies for Problems:
- There is no automatic right to a refund or exchange simply because you change your mind, unless we agree otherwise.
- If goods or services do not meet consumer guarantees (e.g., due to faults in materials, workmanship, or not matching the agreed description), we will provide an appropriate remedy under the ACL:
- For minor failures, we may repair, replace, or re-perform the service at our cost.
- For major failures, you can choose a refund and/or replacement.
- If the problem results directly from designs, specifications, or information you provided (and we followed them accurately), consumer guarantees may not apply, and no remedy may be available.
- Refunds, where due, will be processed in the original payment method within a reasonable time (typically 5-7 business days). We may require proof of purchase and inspection of the item.
- For custom designs, once approved by you, no refunds are available for design-related change of mind, but this does not limit ACL rights for manufacturing faults.
